OF LEGAL PERSON CUSTOMER PURSUANT TO PERSONAL DATA PROTECTION

LAW NO. 6698 (“PDPL”)

As TEZMAKSAN MAKINA SAN. TİC. A.S. registered in Turkey (“Company”) and data controller, we hereby notify that your personal data provided by you or authorized representatives of your company or obtained by us from legal platforms (trade registry, public internet pages, your advertisements) shall be recorded, stored, kept, reorganized, disclosed to authorities that are entitled to request these personal data, transferred to local third persons in accordance with PDPL, classified and processed as specified in PDPL in a manner related, limited and proportionate with the purpose of processing for the purposes that require processing within the scope of the business relationships between us.

PURPOSES OF PROCESSING PERSONAL DATA

Your personal data collected in accordance with the law may be processed for legitimate interests of the Company, without prejudice to your rights and for similar other purposes and reasons including but not limited with:

  • Identifying potential customer needs and developing appropriate campaigns, including online and digital campaigns
  • Communicating in order to ensure the execution of works such as purchasing preferences and analysis of developing services
  • Sending and executing mass e-mail correspondence such as company event invitation
  • Sending offers, communicating, making the first sale, conducting tele-sales / online sales activities through the Company or its suppliers in order to establish a contractual relationship with the Company
  • Increasing customer satisfaction in the market, understanding customer needs and improving customer-related processes
  • Customer satisfaction, complaint and dispute management

Your personal data will be kept for the maximum period specified in the relevant legislation or required for the purpose for which they are processed, and in any case, for the legal statute of limitations.

DISCLOSURE OF YOUR PERSONAL DATA TO THIRD PERSONSp>

Your personal data may be disclosed to professional advisors providing services to the Company at home, for using during operations of Tazmaksan Mak. San. Tic. and/or third persons such as major shareholder of the Company or group companies thereof time by time or as required for operations.

We take technical protective measures during transfer in accordance with the applicable legislation and general practices.

YOUR RIGHTS

Pursuant to article 11 of PDPL and subject to the condition of proving your identity, you are entitled to:

  • Get information as to whether the company processes your personal data and if it does so, get information about this activity;
  • Get information on the purpose of processing your personal information and as to whether it was used in accordance with the purpose;
  • Get information as to whether personal data are transferred abroad and on recipient parties

in connection with your personal data.

In addition, you have the right to request the Company to correct your inaccurate and incomplete personal data and to inform the recipients whose data may or may be transferred.

You can request from the Company the destruction (deletion, destruction or anonymization) of your personal data within the framework of the conditions stipulated in article 7 of the PDPL. At the same time, you can request that third parties to whom the data has been transferred or may be transferred be informed about your destruction request. However, by evaluating your destruction request, we will evaluate which method is appropriate according to the conditions of the concrete event. In this context, you can always request information from us about why we chose the destruction method we chose.

You can object to the results of your personal data analysis created exclusively using an automated system if these results are contrary to your interests.

If you suffer from any loss or damage due to unlawful processing of your personal data, you can request compensation for the damage.

Our Company will process your requests free of charge in the shortest time possible and latest within thirty days depending on the nature of your request. However, if the process entails an additional cost for the Company, the fee in the tariff determined by the Personal Data Protection Board may be charged.

PURPOSES OF PROCESSING YOUR PERSONAL DATA

The Company may process your personal data for purposes and legal reasons including but not limited with:

Achieving the purpose required for the performance of the employment contract, in particular;

  • Employee leave approval, viewing remaining leaves, making vacation arrangements

  • Ensuring that payroll transactions are carried out

Your personal data will be kept for the maximum period specified in the relevant legislation or required for the purpose for which they are processed, and in any case, for the legal statute of limitations.

DISCLOSURE OF YOUR PERSONAL DATA TO THIRD PERSONS AT HOME

For the purpose of your security and performance of our Company’s obligations under the law, your personal data may be disclosed to the relevant organizations and institutions and public legal persons such as Personal Data Protection Authority, Ministry of Finance, Ministry of Customs and Trade, Ministry of Labour and Social Security, Turkish Employment Agency (Is-Kur), Information Technologies and Communication Authority to the extent and permitted under the applicable legislation including but not limited with Labour Law, Occupational Health and Safety Law, Social Security and General Health Insurance Law, Law on Regulation of Publications on the Internet and Preventing Crimes Committed Through These Publications, Turkish Commercial Code, Personal Data Protection Law No. 6698, Identity Notification Law. For instance, personal data of employees are shared with the Social Security Institution for the purpose of paying employee and employer premiums.

In addition we may process your personal data for the purpose of:

Achieving the purpose required for the performance of the employment contract, in particular;

  • Performing payroll operations and updating the relevant data in Uyumsoft accounting program. These data are stored in the data registration media of the application itself.

Complying with the requirements within the scope of Labor Law, Occupational Health and Safety Law, Social Security Law and related legislation, other laws and legislation, in particular;

  • We may share personal data with the consultancy firms and private employment offices we work with in order to obtain consultancy on the determination and calculation of the incentives that we can benefit within the scope of the R&D legislation.
  • We may share your health data with our workplace physician for the purpose of applying treatments and health checks.
  • We may disclose payroll information to company auditors so that they can carry out audit activities.

Ensuring security within the company, in particular;

  • For the purpose of workplace safety, we may transfer personal data to the workplace and / or customer business building management to inspect entries and exits.

For complying with our legal obligations, especially;

  • In order for us to exercise our right to defence, we may share personal data with our lawyers and relevant institutions within the framework of our obligation to fulfil legal requests such as court orders or evidence requests, provided that it is in accordance with the applicable law and procedure.

Managing the company, carrying out the business operations, implementing company policies, in particular;

  • We may transfer your personal data to the companies we are affiliated with or cooperate with in order to ensure our internal operation.
  • In order to protect the company data storage capacity, we may disclose personal data to archive companies so that it can be stored during the retention periods.
  • Required personal data may be transferred to the company we work with for reasons such as transportation, vehicle supply, business card printing, parking lot registration

DISCLOSURE OF YOUR PERSONAL DATA TO THIRD PERSONS ABROAD

In case you provide consent, your personal data may be disclosed to third persons abroad for the purpose of communication during travels and trainings abroad, organizing travels and sending bulk e-mails.

In order to post employment ads, introduce ourselves to a wider audience, we may monitor your activities within the Platform within the framework of the Cookie Policy, and share your necessary contact information (such as telephone, e-mail) with third parties conducting these activities in Turkey and abroad.

In order to understand whether you are satisfied with our services and to discover how we can make you and our other customers more satisfied, we may transfer your necessary personal data to foreign and / or domestic companies that conduct customer satisfaction analysis.

For the purpose of auditing and reporting accounting and financial transactions such as budget management, current card opening, invoicing, we may transfer your personal data required to achieve this goal to the companies we are affiliated with and audit firms.
